When Justice Stevens says that the anachronistic Second Amendment is part of the core of what is wrong with trying to run the modern U.S, with an antique Constitution, there is no room to find fault. And when the folks way on out there on the right fringes say that the Second Amendment can’t be “Repealed”, that is nothing other than more “NRA style talking points” deflection.
The answer, of course, is to start from scratch on thinking about what sort of Constitution is going to get us on a firm track into an uncertain, possibly dangerous, and even conceivably unsurvivable (even if not as a species, at least as a society) future. The approach that was written for us over 200 years ago proved to be remarkably serviceable, but it is also way past its “Use BY” date. Witness the Heller decision, witness the Citizens United decision, witness “The Electoral College”, witness the fact that redneck Wyoming, the Dakotas, Montana, Utah, etc. etc. etc. have the same clout in the U.S. Senate as the highly populated, vastly diversified, hugely prosperous and sane Blue State of California.
When we the people convene in the process that can and will be named “THE SECOND AMERICAN CONSTITUTIONAL CONVENTION”, we will bring together the best and the brightest that we have. Hopefully even in numbers of multiple thousands, though that still needs to be negotiated. What, however, is not in question, is that guns will be only a minor side discussion, as almost everyone involved will have real, solid, adult level sets of truly important issues that actually will need to be negotiated over.
Guns? The very clear consensus will be that this is the kind of thing that can be left for debate on a state by state basis later on and that will be that. Our next Constitution will be Progressive. The numbers will demand that. The existence of “President Trump” will compel that. And, if nothing else, our younger generation will rise up (as is now happening) and achieve that.
Guns? Once we take a sane approach at our highest level of societal organization/structure, even that scourge will end up being intelligently managed!
